why does mediation work?

Mediation works because the parties want it to! It enables them to escape the situation where each client has their own legal advisor to ‘fight their corner’. In mediation the parties are working together with a common goal – to find a solution with the minimum cost, stress and animosity.

By keeping their dispute in mediation they can work together with their mediator to find a lasting, constructive and practical solution to their problem. Because the result is of their choosing, and they do not feel that they have been pushed into this by legal advisors or had the result decided by a Judge, they ‘buy into’ the solution, accept it more readily and are willing to co-operate because it is the result they have chosen for themselves.
